Welcome to Clearview Geographic LLC, a specialist consultancy based in DeLand, Florida. We manage and operate www.clearviewgeographic.com (the “website”). Please read and understand these terms carefully as your use of our services implies your acceptance of these terms.
Scope of Our Services: At Clearview Geographic LLC, our team of GIS professionals, scientists, IT experts, and business data consultants provide expertise in geospatial data analysis and interpretation, environmental science, and information technologies. It is crucial to clarify that we do NOT represent ourselves as a professional engineering service or a surveyor/mapping service. Any use of our services should acknowledge this understanding.
Acceptable Use: Your use of our services should always be in compliance with any policies provided within the services. Misuse of our services is strictly prohibited and may result in suspension or termination of our provision of services to you, particularly in instances of non-compliance with our terms, policies, or during an investigation of suspected misconduct.
Communications: When you create an account with us, you give your consent to receive newsletters, marketing or promotional materials, and other relevant information from us. Should you wish to stop receiving these communications, you can opt-out at any time by following the unsubscribe link, instructions provided in our emails, or by notifying marketing@clearviewgeographic.com.
Software & Hardware: Utilization of our services involves various hardware and software components from numerous third-party vendors, including the ArcGIS platform developed by Environmental Systems Research Institute (“ESRI”). Depending on the specific requirements of our services, purchasing or upgrading hardware and software licenses from specified third-party vendors may be necessary.
Content Changes & Guest Writing: If you want to propose changes, additions, or removals to any content on our website or our company’s social media profiles, please reach out to us at support@clearviewgeographic.com.
Disclaimer: We disclaim liability for any damages that may result from the use or misuse of our services. This includes but is not limited to, direct, indirect, incidental, special, consequential, or other forms of damages.
Products & Services: All deliverables, including but not limited to reports, plans, specifications, field data, and notes, prepared by Clearview Geographic LLC, remain our property unless otherwise stated in writing and signed by both parties. Any modification or reuse of these deliverables is subject to prior agreement and appropriate indemnification.
Payment Terms: All payments are due within 30 days of the initial invoice, unless specified otherwise in certain agreements. Clients are encouraged to refer to their Master Service Agreement for any differing payment terms. We accept payments through PayPal, Quickbooks, and the following methods: Visa, MasterCard, American Express, Cash, Check, and ACH Transfer. Alternative payment arrangements or payment plans can be discussed with your account manager. Refunds are typically not provided, and there are no cancellation fees at present.
Account Termination: To terminate accounts and contracts with Clearview Geographic LLC, clients must email their account manager.
Data Handling: Please refer to our Privacy Policy for information regarding data handling.
Intellectual Property: Any intellectual property (IP) owned by Clearview Geographic LLC remains our property. Any IP provided by the client remains the property of the client.
Dispute Resolution: Disputes should be directed via email to exec@clearviewgeographic.com. Clearview Geographic LLC is headquartered in Volusia County, Florida, and the laws of this jurisdiction will govern any disputes.
Third-Party Interactions: Clients may utilize tools and software provided by the Environmental Systems Research Institute (ESRI) or other third-party tools as discussed during the service engagement. Terms of service and relevant agreements for applicable third-party interactions are available to clients upon request.
Maintenance and Downtime: There is no planned maintenance or update periods. In case of any unplanned or unexpected downtime resulting in a loss of service, clients are advised to contact our team immediately.
Customer Support: Customer support is primarily facilitated through account and project managers. Additional support can be made available upon request.
Professional Disclosures: We are not licensed professional land surveyors, and cannot legally document absolute location or verify location accuracy. We are also not licensed engineering professionals. It’s recommended to consult with additional professionals as needed.
Indemnification: Clients agree to indemnify, defend, and hold harmless Clearview Geographic LLC, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from the client’s access to or use of the Service, violation of these Terms of Service, or infringement, or infringement by any other user of the client’s account, of any intellectual property or other right of any person or entity.
